Terms and Conditions

• This giveaway (“Giveaway”) is organised by Encounters Pte Ltd (“Pelago”), where participants can stand a chance to win a Japan Travel & Experience Prize Package with Pelago and Singapore Airlines, in partnership with CherryHill Orchard’s Cherry Blossom Festival.
  
• By taking part in this Giveaway, all participants agree to be bound by these Giveaway Terms and Conditions.
  
• This Giveaway commences 22 July 2024, 0000hrs (GMT+8) and ends 31 December 2024, 2359hrs (GMT+8) (“Giveaway Period”).
  
• This Giveaway is subject to the following conditions:
     – Enter the giveaway via one of the entry methods outlined below in ‘How to enter’
     – Enter your email, accept T&Cs and allow marketing consent during the entry process
     – Be a new or existing Pelago customer
     – Be an Australian resident, aged 18 years or above as at the commencement of the Giveaway.
  
• By taking part in this Giveaway, you agree that any and all personal data submitted may be collected, used, disclosed, or otherwise processed by Pelago for the purposes of the Giveaway and the Prize, including to communicate with the Winner on collection of the Prize. All collection, use and disclosure of participant’s personal data will be in accordance with Pelago’s Privacy Policy at https://pages.pelago.co/en-sg/privacy-policy 
  
• The Giveaway and/or Prize cannot be applied with any other existing Pelago promotions, offers or privileges, unless otherwise stated.
  
• Pelago and Singapore Airlines reserve the right to amend or withdraw any terms and conditions of this Giveaway, and/or terminate the Giveaway, without any prior notice at their sole and absolute discretion.
  
• For the avoidance of doubt, cancellation, termination or suspension by Pelago of this Giveaway shall not entitle any party to any claim or compensation against Pelago for any and all losses or damage suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.
  
• The terms and conditions of this Giveaway shall be governed by and construed in accordance with the laws of the State of Victoria Australia and shall be subject to the exclusive jurisdiction of courts of the State of Victoria.
  

Giveaway Prize Inclusions

• Participants that enter the draw go into the running to win one (1) prize package that includes:
     – 2x return economy flights aboard Singapore Airlines to Tokyo Japan departing from one of seven Australian ports serviced by Singapore Airlines (Sydney, Melbourne, Brisbane, Cairns, Adelaide, Darwin or Perth). The departure and return airport may be selected by the Winner. NOTE: Travel blackout dates apply across Christmas, Easter and School Holiday periods.
     – Four (4) nights accommodation in Tokyo, Japan
     – AUD500 worth of Pelago experiences within Tokyo, Japan
  
• Pelago is not liable for any other travel related expenses incurred as part of this trip including but not limited to: travel insurance, visa application, transport and spending money.
  
• Pelago will not assume responsibility or liability whatsoever for damages, loss or injury resulting from the Winner redeeming the Prize.
  

How to enter:

To enter, participants must make a booking to the CherryHill Cherry Blossom Festival 2024 or Blossom by Light Festival 2024 via:

1. Pelago.com and accept the T&Cs on the checkout page to receive an automatic entry
   OR
2. CherryHill Orchard and click the link on the confirmation page. Guests will be redirected to the top of this page and must enter their name and email and click submit to receive a single entry.

A bonus entry is also available onsite at the festival only by either:

1. Scanning the QR code displayed on site and entering your details.
   OR
2. Joining the 360 photobooth experience and sharing your details to access the video to share to your social media.

• A maximum of three entries total per participant is allowed within the giveaway draw.
  
• Pelago reserves the right to verify the validity and originality of any entry and/or the identity of the participant and to disqualify any participant who is not eligible, who submits an entry that is not in accordance with these Terms and Conditions or in the event of any proven fraudulent activity.
  
• It is the responsibility of the entrants to ensure that their contact details provided through the Registration Process are correct and to notify Pelago of any changes to their contact details prior to the date of announcing the Winner. Pelago will not be liable if it cannot contact any entrant because of any incorrect contact details provided to it by an entrant.
  
• Directors, officers, management, and employees of Pelago, the SIA Group and/or CherryHill Orchard (and their immediate families and friends), or agencies or companies associated with or connected to the provision of the Giveaway in any way, are ineligible to enter. For the purposes of these Terms and Conditions, immediate family means any of the following: spouse, ex-spouse, de- facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step- brother, step-sister or first cousin.

How to redeem:

• The selected winner (“Winner”) will be contacted by a Pelago representative via the email entered for the Giveaway only. An announcement will also be shared via the Pelago official social media (@discoverpelago).
  
• The Winner may be asked to share a copy of their bookings confirmation from either Pelago or CherryHill Orchard to validate their entry.
  
• The following Terms and Conditions shall apply in relation to the tickets awarded to the Winner by Singapore Airlines (the “Tickets”):

1. Travel must be completed by you and your travel companion (each, a “Traveller”) before 31 March 2025. Travel not utilised by this date will be deemed null and void. Tickets must be issued
2. Travel is subject to seat availability for the required Traveller booking subclass ‘W’ and any applicable travel embargoes. During peak travel times in Australia such as Christmas, Easter and the Australian school holidays, and other blackout periods (which Singapore Airlines may notify you from time to time), travel may not be possible as seats may not be available, and you may have to select alternative dates / flights. There may be periods, such as Chinese New Year, where availability is particularly restricted, and you may need to be flexible with your travel plans.
3. Travel is only permitted on Singapore Airlines operated services within the Singapore Airlines network.
4. The Tickets are only valid for a maximum stay of three (3) months, and any unused portion of the Tickets after the expiry date shall be deemed null and void.
5. Each Traveller will be responsible for travel costs to and from the point of departure, spending money, travel insurance, freight, excess baggage, meals, ground transportation, accommodation, and any other expenses. Each Traveller will be required to hold all valid travel documentation to complete their travel as booked.
6. No changes are allowed once each Ticket is issued.
7. The Tickets are not eligible for an upgrade to a higher class through the redemption of KrisFlyer miles and/or SIA partner frequent flyer program miles, and/or payment using credit or debit cards.
8. Tickets are not eligible for the accrual of KrisFlyer miles and/or SIA partner frequent flyer program miles.
9. Each Ticket is non-negotiable, non-transferable, non-exchangeable for cash in part or in full, and may not be sold to any third party.
10. Travellers must travel together on all sectors on Singapore Airlines.
11. An airport no-show will result in the Tickets being forfeited.
12. The Tickets must be booked through the Singapore Airlines Sydney office at least sixty (60) days prior to the desired departure date. Tickets must be issued by 28 February 2025.
13. You and other Traveller(s) must also complete the Travel Preparation Paperwork and any other documents that Singapore Airlines may require from time to time, and send this to the Singapore Airlines Sydney office during the booking process, before each Ticket can be issued.
14. It is recommended to make your flight reservations as soon as possible as flights are strictly subject to availability and confirmation. Your preferred dates/flights may not be available, and you will need to be flexible with travel dates/flights.
15. Any collection, use and disclosure of Winner’s personal data will be strictly in accordance with SIA’s Privacy Policy which is deemed as incorporated into these Terms and Conditions. Acceptance of the Tickets will be deemed as acceptance of the Terms & Conditions and non-compliance may result in the Winner being disqualified, and any Ticket won may be forfeited, withheld, withdrawn or reclaimed.
16. Winner agrees that any and all personal data he/she submits (including his/her name, contact number, passport number and email address) may be collected, used disclosed, or otherwise processed (collectively, “Processed”) by SIA for the purposes of issuing the Tickets as well as to communicate with the Winners on the redemption of the Tickets.

• The 2025 cherry blossom season in Japan is estimated to commence from end-March to early April. Cherry blossoms tend to be in bloom for approximately two weeks within the season. It is the Winner’s solely responsible to carefully select and plan the trip to best optimise the cherry blossom (if desired) within the available travel dates specified by Singapore Airline above.
  
• The following Terms and Conditions shall apply in relation to the Accommodation and Experience Prize pack awarded to the Winner by Pelago (the “Travel Experiences”):

1. The Winner must advise their travel dates to Pelago to confirm their accommodation booking at least 45 days prior to departure.
2. The Winner must confirm their $500 Pelago experience bookings at least 30 days prior to departure.
3. $500 worth of experiences within Tokyo, Japan must be selected from Pelago.com only.
4. It is recommended to make your reservations as soon as possible as experiences are strictly subject to availability and confirmation. Your preferred dates/experiences may not be available, and you will need to be flexible with travel dates/experience selection.
5. Pelago shall not be responsible for any auxiliary expenses incurred or damage or injury suffered as a result of, or in connection with the Giveaway and/or redemption or use of the Prize however arising. The Winner is also responsible for all applicable taxes on the Prize.
6. Winner Selection & Announcement:

• The Giveaway will be a game of chance and the selection of the Winner will be by random draw by Pelago from all the entrants who have completed their entry in accordance with these Terms and Conditions. Entries will be placed into a random draw and the Winner will be chosen at random from all eligible, valid and complete entries received. All entrants will have an equal chance of being drawn.
  
• The Winner will be contacted by a Pelago representative via the email entered for the Giveaway only before 31 January 2025. An announcement will also be shared via the Pelago official social media (@discoverpelago).
  
• Pelago reserves the right to alter the Giveaway conclusion date at any time within prior notice.
  
• If the Winner fails to respond to the email or contact Pelago after 7 days, Pelago reserves the right to select an alternative Winner (Redraw). The redraw process will repeat the above Winner selection process.
  

Privacy Policy & Data Usage:

• All bookings are subject to Pelago’s Terms of Use, and all collection, use and disclosure of personal data submitted for purchases made during this Giveaway will be in accordance with Pelago’s Privacy Policy.
  
• Participants will be added to the Pelago marketing consent database upon entry into the Giveaway and will be subject to receipt of marketing communications deemed relevant by your demographics or marketing preferences.
